India needs ‘Fast Track Judiciary’ and not ‘Fast Track Courts’

We innovated in judicial system and bought special fast track courts, which deliver their judgments within two, three years. Our conventional courts run the matter and deliver the judgments in decades. High profile cases stay pending for decades if not years, judgment coming after twenty years is assumed to be an early judgment. Ten year’s legal fight is normal.

All these necessitated in creation of fast track courts, as said they deliver their judgments in time frame of two, three years. Lets analyze our this creations in light of the Constitution of India; our Constitution talk about ‘no discrimination on various grounds’. Would not sanity consider the very creation of fast track courts as discriminating? Because, when we already had a system, on which guidance of our Constitution do we give special time frame to particular courts, while we leave other courts in judicial traffic jam? Are not we discriminating?

What was a much better legal solution was rather than creating some fast track courts we should have worked for speeding up our complete judicial system. It would had really given meaning to justice if our judicial system had accelerated. Overall growth of a tree makes it look appealing rather than few shoots showing growth while whole tree shows sign of dormancy.

We need our whole judicial system to become fast track, rather than few fast track courts. Every court should become fast track court. Every section of our legal codes should also have time frame of days, month and years within which their corresponding judgments should be met. Else it’s just some branches showing growth on a dormant tree, Honorable Supreme Court of India should look into this aspect.

Jabke hamari aam adalato me maamle dashako tak chalte hae tab kahi faesle aate hae. Bade bade maamle dashako tak latke rehte hae agar saalo ki baat na ki jaye to, biis saalo baad faesla aana koi achamba nahi hae, balke oose jaldi aaya hua faesla mana jata hae. Das saalo ki qanuni ladayi bilkul aam baat hae.

In sab wajah ke tehet hume fast track adalato ki sthapna karni padi, jaise ke sab ko pata hae ke ye adalate do ya tiin salo me faesla sunati hae. Chalo inki sthapna ko Bharat ke sanwidhan ki rauwshni me dekha jaaye; hamara sanwidhan vibhinn prakaro ke bhedbhaao se rokta hae. Kya aqalmandi fast track adalato ki sthapna ko bhedbhao nahi manegi? Kyuke hamare paas pehle se hi prakriya maujood thi, Sanwidhan ke kis nirdesh anusar humne kuch hi adalato par faesla sunane ke liye samay sima niyamit ki, jabke humne baaki adalato ko adalati traffic jam me rehne diya hae? Kya ye bhedbhao nahi hae?

Samasya ka behtar qanuni hal to ye hota ke kuch hi fast track court banane se acha tha ke hum kuch aese pravidhan laate jinse puri ki puri kanuni prakriya me hi tezi laayi jaa sake. Us se nyaay ka asal matlab ujagar hota agar hamari puri adalati pranali me tezi laayi jaati. Kisi ped ki puri ki puri pragati oose khubsurat aur aakarshak banaati hae naaki kuch daliya haribhari ho aur pura ka pura ped patjhad me dikhayi de raha ho. 


Humari zarurat puri ki puri nyaay pranali puri ki puri adalati pranali kohi fast track bana dena hae, naaki kuch khas fast track court ki sthapna. Har adalat har nyayalay fast track honi chahiye. Har ek qanuni qalam me uspar banaye gaye maamlo par kitne dino, mahino aur saalo me faesla aa jana chahiye ye maryadit aur ghoshit hona chahiye. Warna aesahi hae ke ped ki kuch daliya to haribhari hae jabke pure ped se patjhad ka sandesh aa raha hae. Bharat ke Maanniya Ucchatam Nyaaylaya ko is maamle me vichar karna hoga.

SEBI should put a ban on ‘Retained Earnings’

SEBI (Security and Exchange Board of India) should put a ban on ‘Retained Earnings’, to really make investments meaningful. Investment in shares implies limited partnership thus whole EPS (Earning per share) be distributed to shareholder, profit or loss. It should be exclusively investors’ prerogative to reinvest or not.

Investors don’t consider share with a view to reap benefit or liability of profit or loss. They are solely interested in selling and purchasing shares in market, this makes limited partnership worthless, and that’s what secondary market is all about. I would prefer to call it secondary level brokering than investments or limited partnership.


I feel it’s more important to deal with domestic problems first than to compete with international community. How could one clarify our share markets are solely meant to compete with international markets? I am sure our motives are quiet different we are more concerned about upbringing our people. On basis of words of preamble to Constitution of India; I can be sure enough that our share markets are not meant to benefit solely corporate giants, for them to make millions and billions of worth, but to bring money to ordinary Indians. Ban on ‘Retained Earnings’ is the best solution to change the scenario and benefit ordinary Indians.

I know all these require heavy legislations, but this is not the epitome of problem. Our instinctively static institutions along with corporate bribery from institution’s to legislative level is what the actual problem is all about; why ordinary Indians still remains busy in earning daily breads and corporate giants earn yachts and enjoy exotic holiday every third day, these institutions are fooling Indians who they are actually meant to serve, and blame international ups and downs for public problems, no one talks about how much bribe these static pot belly officers and politicians get from corporate giants to make use of loop holes of laws and benefit their motives by regulations.


Ban on ‘Retained Earnings’ would affect the industries on various fronts, but the motive of the ban is to come heavily on hoardings of millions and billions of worth by corporate giants. We need go through the phase to establish what the Constitution of India aspires. There are a lot of ways out to solve acute immediate effects, provided we are intending to talk the dynamic step.


General investors are fooled by letting them take part in elections and having no say in EPS distribution. If they are limited partners they have sole right to reinvest or not. Ban on ‘Retained Earnings’ will up bring general investors finances, that’s what real partnership is all about and step toward economic equality and justice.
SEBI should ban ‘Retained Earnings’, if not and for sure it will not, than at least open gates and ease hurdles to set up alternate markets where such concept could be practised. If corporate bribery doesn’t come into play such alternate markets where ‘Retained Earnings’ are barred could become reality, making public real partners and not foolish voters; bringing meaningful monetary benefit to general investors.

SEBI ko ‘Retained Earnings' par pratibandh laga dena chahiye

SEBI (Bharitya Pratibhuti aur Vinimay Board) ko ‘Retained Earnings/ fayde/ laabh ki wo rakam jise baanta naa gaya ho balke company me hi dobara jama kar liya gaya ho’ par pratibandh laga dena chahiye, taake nivesh sahi maaino me nivesh ban sake. Share me nivesh ka matlab hota hae maryadit partnership isi liye pura ka pura EPS (Earning per share/ ek share ki puri kamaayi/ fayda) ko share holder ko de dena chahiye, fayda ho ya nuksaan. Dobara us fayde ko nivesh kare yaa naa kare ye niveshak ka niji faesla hona chahiye.

Niveshak share ko fayda ya nuksan ki drushti se kam hi dekhte hae. Wo zyada dhyaan us baat par rakhte hae ke kis share ko kitne me bhecha yaa kharida jaaye, ye maryadit partnership ko be-matlab bana deta hae, aur yehi hota hae duwatiya bazaar. Mae to ise duwatiya shreni ki dalaali kahunga naaki duwatiya shreni ka bazaar aur naahi maryadit partnership.


Mujhe lagta hae adhik zaruri maamla hae ke rashtriya samsyaao par dhyaan diya jaaye naake antar-raashtriya houd ki taraf. Koi ye kaese saabit kar sakta hae ke hamare share bazaar sirf antar-raashtriya houd me barabari haasil karne ke liye chalaaye jaa rahe hae? Mujhe yaqin hae ke hamaare raaste aur manzil kaafi alag hae, hume zyada dhyaan is chiz par dena hae ke kaese aam Bhartiyo ko fayda pohche. Bhartiya Sanwidhan ki prasthawna ki bunyad par mae ye keh sakta hu ke hamaare share bazaar is liye nahi chalaaye jaa rahe hae taake corporate diggajo ko hi fayda pohoch sake, taake wo karodo abjo kama sake, balke is liye chalaaye jaa rahe hae taake aam Bhartiya nivesh ke maadhyam se paise kama sake aur apni aamdani ko badha sake. Aam niweshak ke saath khilwaad hi hota hae jab unhe corporate elections me to hissa lene diyaa jaata hae par kitni kamaayi niweshak ko naa baant kar dobaara company me jamaa kari jaaye is maamle me bolne ka haqq nahi hota. Agar niweshak limited partners hote hae to ye sirf unka adhikaar hae ke wo apni kamaayi dobaara company me daale ya nahi. Retained Earnings/ Kamayi ke adhik hisse ko company me dobara jama karne par pratibandh lagaane se aam niweshak ko company ki kamaayi me pura maryadit hissa milega aur uski aamdani badhegi, asal maayno me isi ko kaha jaa sakta hae partnership aur saath hi ye aarthik barabari/ samaanta aur aarthik nyaay hoga.
SEBI ko Retained Earnings/ Kamayi ke adhik hisse ko company me dobara jama karne par pratibandh laga dena chahiye ye, agar nahi tou aur yaqinan aesa nahi kiya jayega, tab bhi kam se kam samaan darjo ke dusre niwesh bazaar kholne ki anumati deni chahiye aur unke gathan me aane wali qanuni pareshanio ko kam kardena chahiye, ye wo niwesh bazaar honge jaha company ko kamayi ki puri rakam niweshako ko unke share ke mutabik baantni hogi. Agar coporate diggajo se rishwat ka asar naa ho tou aese niwesh bazaar zarur khole jaa sakenge jaha ‘Retained Earning/ Kamayi ka adhik hissa jise company me dobara jama kar liya jaata hae’ par pratibandh hoga, saadhaaran niweshako ko asal partner hone ka darja milega naaki wo sirf murkh voter honge; sahi maayno me unhe niwesh se kamaayi karke apni aamdani badhane ka ausar milega.

National Restaurants Program

Poverty is biggest obstacle in our country India. Worst face of poverty is starvation and malnutrition. Rural and tribal areas in India face the worst forms of starvation, malnutrition and poverty.

I propose to the Government of India and all the State governments to start ‘National restaurants program’ in Hyper-Rural and Hyper-Tribal areas. Under this program, a particular government’s office (ie: schools) would set up a standard size restaurant with a standard size store yard, standard size kitchen, standard equipments and standard staff, potable water facility.

Neither ‘National restaurants’ nor the program have any name after any leader or any such, just ‘National Restaurants Program’ and ‘National Restaurants’ be used.

The restaurant would serve free meals two times a day to all those who may come in. The facility should be free to all, without any reservations or let. Both local people and travelers can demand food at the National Restaurants free of cost.

The food should meet the basic requirement,

basic amount (weight) and basic nutritional value. The food should be as simple and basic as possible, remember the motive here is just to deal with starvation and malnutrition. The food should be pure vegetarian, so that no needy person avoids it on religious or other grounds. Simultaneously potable water facility should be available, which too would be free of cost.

The servings should be supplied on use and throw paper plates, or any recyclable plates and glasses. The facility should be provided only on the spot and should not have delivery system. Only special cases should have delivery at home facility (extremely handicapped or extremely old). The two meals timing should each have 3 hours (12 noon to 3 pm) long duration in afternoon, and 3 hours (7 pm to 9 pm) long duration at night. No identity or registration be required, just come and get served principle be undertaken. Once again, food should be vegetarian, simplest, basic nutritious with potable water.

Government of India should start the program in its initial phases in about 100 most hyper-rural and hyper-tribal areas around the country. Centers should be equally distributed in maps to make program nationwide. State government too can start in about 50 most hyper-rural and hyper-tribal areas under their jurisdiction but they should not be those which are selected by Central Government of India. One area one ‘National Restaurant’ principle be employed. The mesh of National restaurant by this would become dense.

It should directly be under control of local magistrate or such similar officer. More than one check-up agencies be employed to overlook if the program is running as per regulation and to check any discrepancies. Media should also be welcomed in its checks.

Is program ke anusar, koi ek rashtriya karyalay (jaese ke: paathshala) ek nirmit jaga ka bhojanalay, nirmit godaam, nirmit jaga jitni rasoi, nirmit saamaan aur nirmit adhikari ke samoh ka prabandh kare, saath hi pine ke pani ka prabandh bhi kare.

Naahi ‘Rashtriya Bhojanalay’ aur naahi is Program ko kisi neta ke naam par ya aesa hi koi naam par chalaya jaaye. Sirf ‘Rashtriya Bhojanalay Program’ aur ‘Rashtriya Bhojanalay’ kaha jaaye.

Bhojanalay me din me do baar bhojan/ khane ka prabandh kiya jaye, koi bhi insan/ wyaqti jo bhi aana chahe bhojanalay me. Bhojan/ Khana muft me prapt karwaya jaaye, beghair kisi rok tok ya beghair kisi aarakhshan ke. Rehwasi aur aane wala koi bhi yaatri ‘Rashtriya Bhojanalay’ me aakar muft bhojan/ khane ka laabh utha sakta ho.

Bhojan/ Khana niyamit wazan, niyamit poshan ka ho.

Bhojan/ Khana adhik hi saadha ho, yaad rahe ke yeha sirf bhukmari aur kuposhan ki samasya se nipatne ki koshish ki jaa rahi hae. Bhojan/ Khana shudh shakahaari ho, taakey koi bhi bhuka insan/ wyaqti kisi dharmic aastha ko thes pochaye beghair hi aakar bhojan kar sake. Saath hi pine ke pani ki wyawastha ka prabandh bhi muft ho.

Bhojan/ Khana kha kar phek dene wali pleto me diya jaaye, ya to koi recyclable plate aur glass me. Bhojan sirf bhojanalay me hi diya jaaye aur ghar pochchane ki wyawastha naa ho. Sirf koi khaas wajah se khana ghar bheja jaye (adhik apahij ya adhik budha). Bhojan/ Khane ka samay 3 ghante lamba ho dono samay par; dopahar 12 baje se lekar 3 baje tak aur raat ko 7 baje se lekar 9 baje tak. Kisi bhi tarike ki pehchan ya panjikaran zaruri naa ho, sirf aao aur khana khao niiti ho. Ek baar phir bhojan/ khana shudh shakahaari ho, saadha ho aur poshak ho saath hi pine ka paani ho.

Bharat Sarkar shuruwati daur me 100 adhik pichde hue gaawu aur adhik pichde hue dehato me aese ‘Rashtriya Bhojanalay’ khole. Bhojanalay is tarike ke khole jaaye ke Bharat ke naqshe par ek saman duri par phaele hue ho aur poore Bharat me phaele hue dikhayi de. Pradesh ki sarkare bhi shuruwati daur me apne apne pradesho me 50 Bhojanalay (naam Raskhtra bhojanalay hi ho) khole apne adhik pichde hue gaawo me aur adhik pichde hue dehato me, par us jaga nahi jaha Kendra Sarkar ka Rashtriya Bhojanalay pehle se khula ho. Ek jaga aur ek ‘Rashtriya Bhojanaalay’ ki niiti ho. Is tarah Rashtriya Bhojanalay ka jaal desh bhar me phael jayega.

Rashtriya Bhojanalay sidhe Majistrate key ya unke samaan kisi aur adhikari ke haath ke andar ho. Ek se zyada jaanch agensiya unki dekh rekh par lagayi jaye, jo is baat ka khayal rakh sake ke Bhojanalay Qanun ke hisaab se chal rahe hae. Prasaaran (Akhbaar aur TV channels) ka bhi sahyog liya jaaye unki dekh rekh me.

Put an end to 26th January’s Republic Day parade!


Republic day 26th January is the day our Constitution came into effect in 1950. Our Constitution is aspiration of Indian people; it inspires us to achieve our goals which are nothing but overall development of India and its people.

Constitution was bought into effect to set our goals and inspire us to achieve those goals. The 26th January 1950 was obviously a great day and was to be celebrated. Why do we celebrate it with parades now? Have we achieved our goals? Are we at least in right direction at right velocity, have we covered the proportional distance? If no, what reason we are left with to show pomp and take out costly parades?


Constitution nowhere states celebration of 26th January through costly parade as fundamental duty! We should appeal to Honourable Supreme Court to interpret the constitution and justify whether costly and pomp parade are in confirmation with ethos of our Constitution considering our current needs?

Vast amount of money is spent and gigantic amount of security is imposed which too adds to the cost for a two/ three hour parade, which people these day don’t even watch on DD Channel, is not appropriate specifically when we compare our national parameters with other countries’ and find ours nowhere in comparison with theirs, ie: GDP, GNP, HDI, Gini etc.

Celebration for sake of just a convention is not worthy when we have a tiresome journey ahead and we have been laggards all these years since 1950. Other countries do the pomp show and they too have serious problems but do we compare our proportion of expense and our basic needs and problems with theirs?

I dream of a government which will bring an end to pomp parades and wastage of money on security and arrangement of an event which doesn’t raise our national average index of people’s quality of life. Since, 1950 up to now what we should have been and what we are, no reasons are left with us for such pomp.

I dream of a government which comes to the conclusion that we seriously need infrastructures and not parades as gifts of our consecutive Republic days. I dream of a government which comes to conclusion that the vast amount of money which is spent on organization of pomp parades and security could be used for much better cause towards achievement of our goals as set in Constitution.

I dream of a government which gifts us with world class best of the time Hospitals in isolated areas of country (ie: North-East India) as Republic day gifts year by year. I dream of a government which establishes best of their time Medical, Engineering, IT, agricultural, Law colleges and universities as Republic day’s gift to nation on yearly basis.

I dream of a government which establishes power stations, airports, sea ports, manufacturing zones, corporate parks, I dream of a government which erects new highways, railways, stations as gift for Republic days. A hungry man doesn’t need balloons and fireworks as gifts on his birthday he simply needs some breads, there could be no better gift than bread for a hungry man on his birthday.

I dream of a government which recognizes that putting more infrastructures in metropolises would intensify density of population in metropolises and that developing infrastructures in isolated and neglected regions would be pivotal for overall development of India.

To say is awesome, but where would the money come from? The same money which is spent on costly parades and tremendous security should be diverted to develop infrastructures. One may say that developing infrastructure would be very expensive than arranging parades, but a proportional amount of infrastructure with the money used for parades could be developed very well. For sure on just 10th consecutive Republic day once we undertake this practice; India would be a changed country.

To flutter our own flag in our own country doesn’t cause money to be spent. A simple ceremony by President and Governors would be best course of action considering what our present constrains are towards our development.

I dream of a government which would surely consider the above stuffs.

26th January ko hamara sanwidhan/ aayin lagu hua tha 1950 me. Hamara qanun hamari ummid hae, wo hume aage badhne aur apni manzil pane ke liye jagata hae, ye manzil sirf aur sirf India aur uske logo ka har tarah ka development hi hae.

Qanun sirf isi liye lagu kiya gaya ke hum apni manzil pata kare aur ose hasil karne ke liye aage badhe. 26 january 1950 both bada din tha aur uski khushiya manana bhi zaruri tha. Par hum aaj kis baat ki khushiya manate hae parade nikal kar? Kya hume apni manzil mil gayi? Kya hum sahi direction me chal rahe hae, kya humko jitna safar tay karna tha kar liya? Agar nahi to phir hume ye mehengi parade kyu organize karni chahiye?


Constitution me kahi bhi nahi likha hae ke 26 january ko mehengi parade nikalna fundamental duty hae! Hume Honourable Supreme court se appeal karni chahiye ke wo constitution ke provisions ke sahi meanings bataye aur ye tay kare ke kya mehengi parades constitution ke hisaab aur time ki zarurat ke hisaab in dono ke hisab se sahi hae?

Boht zyada paisa kharch kiya jaata hae aur both sari security ka bandobast karna padhta hae jiska kharch bhi kaafi hota hae sirf do/ tin ghante ki parade par, jise ab log DD Channel par dekhte bhi nahi hae, ye sab sahi nahi hae, tab jabke hamara mulk dusre mulko se both piche hae, jaise ke: GDP, GNP, HDI, Gini waghaera ke ranks me.

Kaash koi aesi sarkar aaye jo parade ko khatam kare jisme boht paisa saath hi saath uski security par bhi both paisa kharch ho jata hae, jisse aam Indian ki life bhi nahi sudharti. 1950 se aaj tak hume kaha pohoch jana chahiye tha aur hum kaha reh gaye, ab hamare liye aesi parade par kharcha karna band kar dena hi sahi hae.

Kaash koi aesi sarkar aaye jo is natije par pohche ke hume saal dar saal bade bade developments gift dene chahiye Mulk ke logo ko naaki parade. Kaash koi aesi sarkar aaye jo is natije par pohch sake ke itni zyada daulat sirf parade ke upar aur uski security ke upar kharch karne se acha developments par kharch ki jaye to jo manzil India ka Qanun batata hae uski taraf ek acha qadam hoga.

Kaash koi aesi sarkar aaye jo hume apne time ke best hospitals bana kar dey sake wo bhi mulk ke pichde hue ilaqo me jaese ke North East India, Republic day ke gift me saal dar saal.
